 note = {近年、医療介護保障法制にみられる「事業型施策」は、社会的給付の形式を採らず、幅広い対象者を想定していること、公的資金助成や保険料を財源として各種事業が実施されていること、事業の実施にあたっては各種民間組織との協働，連携が必要とされているといった特徴がみられる。多様な事業を法的に把握するためには、サービスへのアクセス、サービスの質、サービスに係る費用の効率化などから構成される利用者の利益という分析枠組みの設定が有用である。その上で、このような観点から諸利益の内容と相互の調整関係についてさらに検討を深めていくことを今後の課題として確認した。, The features of program-based services in health and long-term care law are as follows: services are not provided as defined benefits for beneficiaries; a wide range of people are targeted; necessary costs for programs are provided by public funds and social insurance premiums; cooperation with various private organizations are required in the implementation of programs.
It is important to establish an analytical framework of users' benefits that consists of access to services, quality of services, and efficiency of service costs in order to legally examine diverse programs.
