| 内容記述 | 中世盛期（1100-1250年）ドイツ封建社会の城塞支配権はフランスのシャテルニー（城主支配権）と同質的な支配権であることが、上部バイエルンの貴族ファルケンシュタイン伯の4つの城塞（ノイブルク、ファルケンシュタイン、ハルトマンスベルク、ヘルンシュタイン）を例として史料に即して究明された。つまり、伯は城塞の周囲で、特に高級裁判権（流血裁判権と高級贖罪裁判権）・教会守護権、水車使用強制権等の罰令権力、荘園支配権、城塞守備封臣に対する封主権等、フランスの城主のシャテルニー権力と類似の支配権的権利を行使したことが解明された。この結論は伯の城塞に限らずドイツの城塞に一般化しうることも論証された。 | |||||

| 内容記述 | According to historical materials ,it was made clear by way of examples of four castles(Neuburg,Falkenstein,Hartmannsberg and Hernstein) which the Counts of Falkenstein of German Upper Bavaria possessed that the castle lordship in the High Middle Ages was the same lordship as the castelry(lordship of the castle) in the history of France. In other words, it was investigated that the Counts of Falkenstein held and exercised in the surrounding territory of those four castles the similar rights and powers to the castelry of French lord of castle, especially compulsory rights and powers, that is the high jurisdiction (blood jurisdiction and high expiating jurisdiction), protective lordship over church and monastery, compulsory power of watermill-use, besides the manorial lordship and the lordship over castle guard etc. It was also demonstrated that this conclusion is to be generalized up to the German castle. | |||||
