| 内容記述 | The paper aims to evaluate how effectively the registration system for traditional medical knowledge (TMK) in Vietnam functions to respond to the distinct features of TMK and the expectations of its stakeholders. The evaluation is conducted in consideration of the system's legal/institutional integrity, adaptiveness to TMK features, and response to TMK stakeholders'desires. The paper concludes that the current registration system that is substantially based on conventional copyright regime, from both theoretical and practical perspectives, finds it hard to accommodate the unique nature of TMK and the legitimate concerns of TMK stakeholders. In the light of lessons from failures of the system in the past and experiences from other countries, the paper gives argument in defense of adopting a sui generis approach for legal reform. |

| 内容記述 | 本稿は，ペトナムの伝統医療知識(TMK)の登録制度がTMKの明確な特徴とステークホルダーの期待にどのように対応するかを評価することを目的としている。評価は，システムの法的・制度的確実性,TMK機能への適応性,TMKステークホルダーの要求への対応を考慮して行われる。本稿は、理論的および実践的な観点から，従来の著作権制度に実質的に基づいている現在の登録 システムがTMKの固有の性質およぴTMKの利害関係者の正当な懸念に適応することは困難であ ると結論づけている。過去の制度の失敗や他国の経験から得た教訓を踏まえ，法律改革のために採択すべき十分なアプローチを守るための議論を提供する。 | |||||
