 note = {共犯現象を適切に解決するためには共犯者間の「心理的働き掛け」の内実を解明することが必要である。本研究では，事例研究も含めて間接正犯，教唆犯，幇助犯といった共犯者間のやり取りが問題となる形式について研究を行った。その結果，共犯者間の意思形成過程を理解するには，少なくとも両者の人間関係などを具に観察し，一方共犯者による「働き掛け」が犯罪的内容を含んでいることが明確に理解でき，かつ他方がその意図を正しく受け取っていることが必要であると示された。また，このことがあらゆる共犯形式において妥当し得る可能性も示された。, It is important to reveal substance of "psychological interactive" between accomplices. I studied various complicity problems, using case-method or other. The outcome is thus; It is necessary that we observe relationships between accomplices (including those before criminal act) in order to understand will-forming process, and that interactions from one accomplice obviously include criminal content, and the other receives the content.
