 note = {本研究では変容する家族という視点から、日本における今後の未成年後見制度および成年後見制度の在り方について検討を行った。超高齢社会、少子化が進む中で家族に依存しすぎない制度設計を展開していくべきである。また、ドイツにおいては、未成年後見や世話制度（ドイツの成年後見制度）に関して法改正の検討が進められており、2016年、2018年にそれぞれドイツ連邦司法消費者保護省から公表された部分草案について紹介、検討を行い、時代に即した制度設計を行うことの意義について確認することができた。, In this research, I examined the ideal way of the guardianship system for minors and adult guardianship system in Japan from the viewpoint of changing families. In a super-aged society and a declining birthrate, we should　design a system that does not depend on family members. In Germany, a guardianship reform is underway.
