| 内容記述 | 本研究では，多数の医療裁判例を統計学的に検討し，臨床現場のインフォームドコンセントにおいて重視すべき因子として応用が期待されるものを抽出した。これら結果に基づき，医療系学生を対象にインフォームドコンセントに関するアンケート調査を行ったところ，裁判例の結果に合致し，一般化可能と考えられた。 一例をあげると，未破裂動脈瘤の予防的治療治療のように，緊急度が高くない類型において，治療を見合わせる選択肢の提示が不十分であったために，適切に治療の諾否，その方法を選択できなかったと違反が認められやすく，その損害賠償も高額になりやすかった。 |

| 内容記述 | This study analyzed medical malpractice lawsuits statistically and showed that non-urgent cases, such as preventative treatment or cosmetic surgery, were involved significantly more often than urgent cases. When damages were awarded, the courts required medical practitioners to disclose more information about adverse effects that the patient might suffer, and the natural course of the disease with no treatment, especially for preventative treatments. To evaluate the analysis results, medical and nursing students completed a questionnaire survey on informed consent, as they are situated ‘between’ patients and medical practitioners. This revealed that persons who chose follow-up examinations, avoided invasive treatment set a haigh value on information about the natural disease course without treatment. The concordance of the analysis and survey findings suggests that medical practitioners should apply the results clinically. |
