Shigeki"}],"nameIdentifiers":[{"nameIdentifier":"91320","nameIdentifierScheme":"WEKO"},{"nameIdentifier":"50194551","nameIdentifierScheme":"e-Rad","nameIdentifierURI":"https://kaken.nii.ac.jp/ja/search/?qm=50194551"}]}]},"item_9_description_21":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"研究の対象であるドイツのクレジット・カード法の全体を、おもに不正使用の観点から検討した。当初は、わが国における「クレジット・カード法」の立法の当否を視野にいれ、検討を開始したが、研究の進行段階で「消費者契約法(仮称)」の立法の議論が盛んとなった。クレジット・カード契約は消費者契約であり、この法律の規定内容如何によっては、クレジット・カード法の議論にも大きな影響があると思い至った結果、クレジット・カード法の立法の議論はひとまず置き、検討対象を個別問題に絞り込むこととし、したがって、研究成果は、研究課題に関する個別問題について発表することとした。\n第1に、クレジット・カードの署名省略利用につき、ドイツの議論を参考として、わが国での非常に曖昧な実務に警鐘を鳴らし、その厳格な運用、およびクレジット・カード会社の厳格な責任を主張した。この研究成果は、(1)論文として発表した。\n第2に、消費者契約に広く取り入れられているいわゆるクーリング・オフにつき、その期間の起算日が存在しない場合のクーリング・オフの行使制限につき、ドイツにおける議論を参照しながら検討した。すなわち、ドイツでは、消費者信用法においてクーリング・オフの定めがあり、これと、これに関連する諸法を検討し、クーリング・オフ期間の起算日が存在しない場合にも、一定の行使制限を設けることを主張した。この研究成果は、(2)論文として発表される。","subitem_description_type":"Abstract"}]},"item_9_description_22":{"attribute_name":"内容記述","attribute_value_mlt":[{"subitem_description":"研究課題/領域番号:09720026,
