Kazuhiko"}],"nameIdentifiers":[{"nameIdentifier":"2106","nameIdentifierScheme":"WEKO"}]}]},"item_9_description_21":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"所定の期間に於て、本研究がその対象とした、行政権による広報活動に対する法的統制に関して、所期の計画通り、ドイツに於ける判例・学説の検討を行った。幸いにしてSchurmann,Offentlichkeitsarbeit der Bundesregierung,1992.[=連邦政府の広報活動]といった有益な文献を入手することができ、そういった文献を手懸りにして関連する判例を収集、分析した。そうした研究作業によって、行政権による広報活動の中でも、特定の私人にとっては不利益的効果をもたらす[警告](Warnung)をめぐる法的問題の状況を明らかにすることができた。例えば、特定の所謂セクト宗教に対して、当該宗教が特に若者の精神的安定を害し、人格の破壊等の被害をもたらす、という旨の連邦青年家庭保健大臣の言明については、言明の対象とされた宗教団体からの訴えを受けて、1989年に連邦行政裁判所の判決が出ている。同判決はかかる言明を適法であるとしたのであるが、問題は、例えばかかる警告を行う法的根拠はどこにあるのか、ということである。判例は、連邦政府が憲法上有する国家の指導機関としての地位、或いは国家の基本権保護義務を根拠にしている。こういった考え方は、行政機関の活動の根拠を憲法に求めており、行政活動の根拠を何よりもまず法律に求める日本の議論の仕方と大きく異なるものである。同様の問題は製造物に対する政府の警告についても存するが、直接、法律による統制の存在しないこうした事実行為について、その法的統制をあくまで「法律の留保の原則」に忠実な形で法律に求めていくのか、或いは法律を飛び越えて憲法上の組織規範や基本権保護義務論に依拠するのか、という問題が存する。今後本研究で収集した資料を基にこうした行政権による広報活動、ひいては事実行為一般の法的根拠づけ、法的統制のあり方全般についてなお理論的検討を深めていく予定である。","subitem_description_type":"Abstract"}]},"item_9_description_22":{"attribute_name":"内容記述","attribute_value_mlt":[{"subitem_description":"研究課題/領域番号:07852003,
