Koji"}],"nameIdentifiers":[{"nameIdentifier":"107447","nameIdentifierScheme":"WEKO"},{"nameIdentifier":"30180102","nameIdentifierScheme":"e-Rad","nameIdentifierURI":"https://kaken.nii.ac.jp/ja/search/?qm=30180102"}]}]},"item_9_description_21":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"本年度は、次の二つの視点から研究を進めた。すなわち、第一は、前年度研究を行なった、西ドイツの域外適用論との比較という視点であり、第二は、米国反トラスト法の域外適用論と国際私法理論との関係という視点である。\n第一の西ドイツ法との比較については、1989年9月16日の関西国際私法研究会において、「西ドイツにおける経済抵触法の概念」という報告を行なった。西ドイツ法とアメリカ法とを比較すると、前者が、国際法と国内法との関係、抵触法と実質法との関係といった全体構造を視野にいれた法律構成を重視しているのに対し、アメリカ法は、ジュリスディクションの根拠と限界という手法により個別問題を解決することを重視していることが理解された。アメリカ法の議論は、国際法上の議論に傾きすぎているように思われ、わが国での議論に対しては、西ドイツ法の議論の方が参考になると思われた。\n第二の域外適用論と国際私法理論との関係については、1989年9月2日に愛媛大学において「経済法の『域外適用』と国際私法」という講演を行なった。経済法の域外適用問題は、国内裁判所における国際的法律関係への国内法の適用のあり方という問題の一部に他ならず、国内裁判所における国際的私法関係への内外私法の適用のあり方を規律する国際私法上の理論及び方法は、経済法の域外適用問題の解決にも参考になると思われた。とりわけ、サヴィニ-流の双方的抵触規則が、経済法の域外適用問題についても有用であると考えた。現在は、最近のアメリカ法における、域外適用問題に関する利益分析論とカリ-の利益分析論との関係にテ-マが絞られてきたため、このテ-マに関する論文が今年中にまとまりそうである。","subitem_description_type":"Abstract"}]},"item_9_description_22":{"attribute_name":"内容記述","attribute_value_mlt":[{"subitem_description":"研究課題/領域番号:01520021,
