| 内容記述 | （１）労働組合の活性化のために、重要な点は、以下である。①コミュニティ、地域住民、市民運動等との連携、②労働者のニーズの明確化とその実現、③企業の枠を超えた組織や活動スタイルの転換に向けての企業別組合の連合体の重視、例えば、産別組織への権限・機能の委譲、地域組合への二重加盟などである。 （２）憲法28 条が保障する対抗的労使関係に基づく集団的自治を実質化させるには、従来の労働団体法理では限界があり、その見直しが必要である。具体的には、労働者概念、使用者概念、インターネットを用いた組合活動や取引先等に対するボイコットという圧力行動など新奇な活動スタイルなどが挙げられる。 |

| 内容記述 | (1)For the activation of the labor union, the important points are as follows. 1. Connection with the community, the local residents,the citizens' movement and so on. 2. For the transfer to the organisation exceeded the limit of the company, the federation of the company unions is necessary. (2) The conventional labor union principles of law have the limits in order to actualize the collective self-government based on the labor-management relations which the constitution Article 28 guarantees, and it is necessary to review specifically the concept of worker and employer, and novel activity-styles including the activity of the trade union, the pressure action on the employer and the boycott using the Internet. |
