| 内容記述 | 本研究によりケベック民法典における第4編第7章の「他人の財産の管理」の個々の条文の意義とともに、その理論的基礎に権限（pouvoir）概念が据えられうることが明らかになった。また、ケベック民法典が財産編に設けられた理由としては、信託と充当資産との密接関連性があることが明らかになった。ケベック民法典が「他人の財産の管理」を包括的に規定した発想は、我が国の債権法改正における「役務提供契約」の総則的規定を設ける議論と通底するところがある。さらに、所有権理論や、自己の財産の管理を再検証する契機としての意義を有する。 | |||||

| 内容記述 | This research clarified the contents of provisions of "administration of property of others" in the chapter 7 of section 4 of Quebec Civil Code. It also clarified the concept of "legal power" as the theoretical foundation of "administration of property of others". The reason why the chapter of "administration of property of others" was positioned as section of "property" is because this section is closely related to trust and appropriated patrimony. The idea of chapter of "administration of property of others" is in common with the idea of the general provision of "service contract" in revision of the civil code of Japan. The concept of "administration of property of others" and power is an opportunity to re-examine the concept of ownership and theoretical foundation of "administration of own property". | |||||
