| 内容記述 | 本研究では、地方自治に関する憲法上の保障が存在しないイギリスにおいて、自治体は、国会制定法によってその権限、さらにはその存在までをも容易に変更・廃止される存在でありながら、自身の権限行使に関する国の違法な介入に対して、司法審査等の争訟手続きに訴えることが可能であり、個々の自治体の自主行政権限が司法救済の対象となる権利性を有していること、またその結果として、イギリスにおいては、地方自治に関して制度的保障が認められながらも、個々の自治体の自主行政権能についての個別的保障に消極的な日本の法制度と比較しても、実質的な自治権保障に遜色がないことが明らかとなった。 | |||||

| 内容記述 | This reserach aimed at clarfying the role of administrative litigation in guaranteeing of a local government's autonomy right of self-government. in England, though under the principle of parliamentary sovereignty, there is no guarantee of a local government's autonomy right of self-government, local authorities are able to make a suit when their autonomy right of self-government are infringed by central government. As a result, we can say that local authorities in England, substantially have a legally protected local government's autonomy right of self-government, and this English local authority's discretion is not inferior to an autonomy right of self-government which japanese local authority's has. |
