| 内容記述 | 本研究では、今日の地方行政にかかわる法と仕組みの一端を明らかにすることを目指し、イギリスの自治体外部監査制度に関する歴史的検討を行った。その結果、①イギリスの自治体外部監査は、19世紀以降その基本的仕組みがほとんど変化しない安定した制度であること、②自治体の財務会計行為に関する統制法理としての受託者の義務が果たしてきた歴史的役割は大きいものの、その具体的意義は時代によって異なっていること、③地方分権化の観点からは、能率監査の結果と国から自治体へ配分される補助金の額と連動させることは、自治体の裁量権を統制する結果を招き望ましくないことなどが明らかとなった。 | |||||

| 内容記述 | This research aimed at clarifying the law and a system of today's local government, through the historical study about the British external audit of local government. As a result, it became clear that the external audit is the stable system that the basic structure has little changed from the 19th century, that the historic role of the concept of fiduciary duty as a law of local government finance is significant, but its concrete implication varies according to the times, and that from a point of the devolution of the local government, it is undesirable to link the efficiency inspection into the local government with the subsidy which is distributed from central government. | |||||
