| 内容記述 | 本研究は子どもが死に至った学校事故において学校（設置者）と遺族とが対立する過程や要因をケース・スタディによって明らかにし、対立を回避し対話を促進する制度構築の手がかりを得ようとするものである。 研究の結果、事故後に遺族らが子どもの被災原因の解明を学校に求めることが学校の「法的責任」を含む「責任」（被災時や被災後の判断など）を追及することを意味してしまうこと、そのため学校は慎重な対応をとるようになり、両当事者の対話が途絶されてしまうことが明らかになった。以上から事故原因を解明する過程における免責制度や対話的関係の形成を可能とする具体的な制度について考察することが必要だと結論づけた。 |

| 内容記述 | This study takes up the case that the families who lost their children in municipal school and the responsible party (the authority) were opposed to another, and tries to understand possible causes of their oppositions. In addition, this study tries to obtain clues that can construct the promoting dialogue system between victims/bereaved families and responsible party. In consequence, this study points out; firstly, in the process of dialogue between bereaved families and responsible party after the accident, the truth elucidation activities concerning the death of children by bereaved families means responsible party is responsible for or not, secondly, the responsibility is often linked to legal responsibility(compensation for damage), thirdly, therefore the dialogue is broken off. From the above, we need to consider immunity form responsibility system to elucidate truth and concrete promoting dialogue system to avoid oppositions between bereaved families and responsible party. |
