| 内容記述 | 児童ポルノの刑事規制根拠の明確化を目的とする本研究では、その規制の伝統に伴う法的議論の蓄積の豊富なアメリカにおける理論状況に係る比較法的な分析も踏まえて、その規制利益の個人的法益性の基本的妥当性を確認すると共に、この個人的法益を被写体児童の人格的利益、より具体的に自由の一種たる自己の性的姿態に係る情報権と構成する可能性について検証した。 | |||||

| 内容記述 | Purpose of this research is to clarify the legal interest（Rechtsgut）of criminal regulation of child pornography. Hence, this research was to analyze such regulations in the U.S., which have rich tradition and arguments of it. From these analysis, it became clear that it was proper to construe such interest as a personal one, and in fact, such interest was like a liberty or a right to control one's personal information.Purpose of this research is to clarify the legal interest（Rechtsgut）of criminal regulation of child pornography.
