| 内容記述 | 本研究では、子の福祉にかなう未成年後見制度を再構築していくことを目的に、我が国ならびにドイツ法の検討を行った。その結果、2010年12月の「児童虐待防止のための親権に係る制度の見直しに関する要綱案」で示された法人後見や複数後見人制度を改正の第一歩ととらえ、さらに、ドイツ法のような公的後見の導入や、ドイツの「未成年後見及び世話法改正法草案」で示されたように、後見人と被後見人間に、より個人的な関係を形成しうる制度設計を検討していくことが今後、重要であるとの結論に至った。 | |||||

| 内容記述 | The purpose of this research is to reconstruct the guardianship for the welfare of children. Especialy for prevention of child abuse, it is meaningful to introduce new systems, like Vereinsvormundschaft, Mitvormundschaft, and also Amtsvormundschaft(German system). The role of the guardian is to undertake responsibilities for the child.Therefore the guardian should be obligated to have a personal contact with child(for example in a month) (cf. a German Bill in 2010 'Entwurf eines Gesetzes zur Anderung des Vormundschafts- und Betreuungsrechts'). |
